Terms of Use – Cue Noir: Billiards Club

1. Agreement

These Terms of Use ("Terms") govern your use of the mobile game Cue Noir: Billiards Club (the "App") published by [[Legal entity name]] ("we", "us", "our"). By downloading, installing or playing the App you agree to these Terms. If you do not agree, do not use the App.

The App, including its software, game design, levels, graphics, sounds, music, text and translations, is owned by us or our licensors and is protected by copyright and other intellectual property laws. Except as expressly permitted, you may not copy, modify, reverse engineer, decompile, distribute, sell, rent or create derivative works from the App.

Trademarks and product names of third parties are the property of their owners. The name "Cue Noir" and any related logos are our property.

5. Acceptable use

You agree not to:

• use cheats, bots, modified clients, or tools that interfere with the App or its gameplay;
• attempt to bypass any technical restriction or access controls in the App;
• use the App in violation of any law or regulation;
• upload or distribute harmful, offensive or unlawful content through any feature of the App (where such features exist).

6. In-game items and virtual currency

In-game coins and unlockable items (for example cue styles) are virtual items. They:

• have no monetary value and cannot be exchanged for real money or other goods of value;
• are not transferable between accounts or devices;
• may be changed, rebalanced or removed in future updates.

Virtual items are only available inside the App.

If future versions offer purchases with real money, these Terms and the store listing will be updated and the purchase terms of the relevant app store will apply.

7. Updates and availability

We may release updates, add or remove features, or change the content of the App at any time. Some features may require a supported device, operating system version or internet connection. We do not guarantee that the App will be available at all times or free of errors.

8. Termination

You may stop using the App at any time by uninstalling it. We may stop offering the App or terminate your licence if you breach these Terms.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the App will meet your requirements or that it will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or in connection with your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App (which is zero if the App is free).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or fraud.

Consumer rights: if you are a consumer, you may have statutory rights that cannot be waived by these Terms. Those rights are not affected.

11. Indemnity

To the extent permitted by law, you agree to indemnify us against claims arising from your breach of these Terms or misuse of the App.

12. Privacy

13. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted at the URL above and the "Effective date" will change. Continued use of the App after the effective date means you accept the updated Terms.

14. Governing law and disputes

If you obtained the App from the Apple App Store, the Apple Media Services Terms and Conditions and the Apple standard EULA apply in addition to these Terms, and Apple has no obligation to provide maintenance or support for the App. If you obtained the App from Google Play, the Google Play Terms of Service apply in addition to these Terms. In the event of conflict, the stricter terms apply where the law requires it.

If any provision of these Terms is found unenforceable, the rest of the Terms remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App.
